I don't think thats what the warranty says. I think it says something like functionally equivalent.
I got my check in the mail today. When my 6S was returned to me, a refurbished model, it was in better condition than what I sent to Apple. I think that is functionally equivalent.

As far as the $46 figures go, perhaps instead of giving the full $92.17 on one device they provided portions if more than one claim was made e.g., if the same person made two claims on one device, they received $46.08 and $46.09 instead of $92.17.
You just can't accept being wrong, especially after trying to mansplain how multiplication works. Have a thoroughly average day.

The refurbished devices may have in fact been in better condition than what a customer sent in but the complaint was that replacements weren't "new or equivalent to new in performance and reliability" as the warranty stated they would be. Whether or not they were "equivalent to new" was the issue here and Apple decided to settle.

I wonder what these people thought made these devices not equivalent to new?

My replacement was most certainly equivalent to new in performance and reliability. My replacement was the exact same model so it performed exactly the same. In fact it was probably better as the battery was new and some minor scratches on the case and screen were now gone.

Performance was identical in all aspects that I could measure. Reliability was probably better as everything was thoroughly checked by Apple as are all refurbished products.

The lawsuit was brought by a band of leaches, some would say lawyers. To Apple it was cheaper to settle than long drawn out litigation.

I'm not sure. The refurbished devices Apple sells come with the same warranty as new and like new ones, are eligible for the AC+ warranty. I think they are about as close to new as you can get, except perhaps for price.

Yes, but again the issue was not about the device being better than what was sent in but rather it not being "new or equivalent to new..." in their opinions. I think the refurbished devices Apple sells are about as close to new as you can get, except perhaps for price.
